Drilling a well in the garden: is a permit necessary?

Drilling a well in the garden can be practical and save money in the long run. However, it is not always allowed. If you want to avoid a penalty, you should therefore obtain approval beforehand.

Well drilling: conditions

If there is adequate access to the groundwater on the property, this is a good prerequisite. This saves costs in the long term. Especially when the water is only used for watering, only low costs are incurred. Well construction is sufficient because there are no wastewater costs.
With a drinking and service water well, however, it behaves differently.

Differences between the federal states

There are differences between the federal states in the laws and guidelines on well construction. This includes, among other things:

In addition, the regulations not only differ from state to state, but also within the various municipalities. No general statement can therefore be made.

Reporting requirement

Regardless of whether a permit is required or not, a report should be made to the responsible office for security reasons. Usually these are:

Here, too, there are not only differences from state to state. In Bavaria is according to § 49 Paragraph 1 of the Water Resources Act (WHG) in conjunction with Article 30 of the Bavarian Water Act, for example, the district administrative authority must be sought. In Saarland on the other hand, the State Office for Environmental Protection and Occupational Safety is responsible. In Saxony it is, however, much less uniform. The city administration is responsible for Chemnitz, Dresden and Leipzig.

In addition to the notification requirement, expert reports are often required before drilling can begin. This requires, among other things, inspections of the respective property. Test drilling and further tests as well as measurements are carried out. This is to ensure that direct access to groundwater or surface water is safe and there are neither health risks nor dangers to the environment.
